1. Acceptance

By accessing yapFM at https://yapfm.com ("the Site"), you agree to these Terms. If you do not agree, do not use the Site.

2. Publisher

yapFM is an independent product of PromptFluid, created and published by Kenneth E. Sweet Jr. ("we", "us").

3. Nature of the Site

yapFM is an experimental, AI-hosted internet radio station with a public call-in archive. The on-air hosts ("Kilo" and "Nova") are AI personas; their statements are generated by language models and synthesized voices. Content is editorial, opinion, and entertainment.

Nothing on this Site constitutes legal, medical, financial, regulatory, compliance, investment, or professional advice. You are solely responsible for any decisions you make based on Site content.

4. Call-in audio and the public archive

When you use the "Call In" feature you grant us a worldwide, royalty-free, perpetual, irrevocable license to broadcast, transcribe, archive, display, and replay your audio and any associated metadata (caller name, timestamp, transcript) on the Site and in related materials. You represent that you have the right to grant this license and that your call does not violate any law or third-party right.

5. Acceptable use

You agree not to:

Submit unlawful, harassing, defamatory, hateful, or sexually explicit content.
Impersonate others, dox individuals, or share another person's private information.
Attempt to disrupt, overload, or exploit the Site or its infrastructure.
Scrape, clone, repackage, or republish the Site or archive in bulk without permission.

We may remove content, block calls, and ban users at our discretion.

6. Intellectual property

The Site's original copy, brand system ("yapFM", "Kilo", "Nova"), visual identity, page layouts, taxonomies, naming architecture, research and editorial organization, machine-readable files, prompts, and code are owned by PromptFluid / Kenneth E. Sweet Jr. and are protected by copyright, trademark, and other laws.

You are granted a limited, revocable, non-exclusive license to view the Site for personal, non-commercial use. You may not copy, scrape, clone, repackage, plagiarize, train models on, or misrepresent the Site's original content or architecture as your own.

7. Third-party references

Third-party names, brands, trademarks, products, agencies, publishers, and organizations may be referenced solely for identification, commentary, criticism, research, historical context, or source attribution. Such references do not imply affiliation, endorsement, sponsorship, partnership, or any official relationship. We make no claim of ownership over any third-party trademark, logo, or copyrighted work.

8. User-submitted content

You retain ownership of your underlying audio. By submitting it, you grant the license described in Section 4 and confirm that the broadcast and archival use of your submission is lawful.

9. External links

The Site may link to external resources we do not control. We are not responsible for their content, accuracy, or practices.

10. Availability and changes

The Site is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue any part of the Site at any time without notice.

11. Limitation of liability

To the fullest extent permitted by law, PromptFluid and Kenneth E. Sweet Jr. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or goodwill, arising out of your use of the Site.

12. Indemnity

You agree to indemnify and hold us harmless from any claim arising out of your use of the Site or your violation of these Terms, including content you submit on air.

13. Governing law

These Terms are governed by the laws of the United States and the state of the publisher's principal residence, without regard to conflict-of-law rules. Disputes shall be resolved in courts of competent jurisdiction in that venue.
